Terms and Conditions of Sale

These Terms and Conditions of Sale govern both the general use of www.sensenu.com and www.oriolrod.com, and the purchase of products through them, under the Oriol Rod Studio umbrella, which includes the projects Oriol Rod (original artwork, drawings, and giclée reproductions) and SENSE NU by Oriol (fashion accessories). They replace any previous version of the "Terms and Conditions" published on the website.

2. Purpose and acceptance

Access to and browsing of the website, as well as the purchase of any product, implies full acceptance of these Terms and Conditions of Sale. Use of the website's content (texts, images, artwork) is also governed by our [Legal Notice] on intellectual property, and the processing of personal data by our [Privacy Policy] and [Cookie Policy].

3. Products and availability 

Products are shown with their description, images, and price at the time of publication. As some are limited-edition or handmade pieces, availability may be limited or run out; in such cases the User will be informed as soon as possible, and offered an equivalent product or a refund of the amount paid.

4. Prices and taxes 

Prices are shown in euros (€) and include applicable VAT. Shipping costs, where applicable, are shown separately before completing the order and are detailed on our [Shipping Information] page.

5. Purchase and payment process 

The purchase process takes place through the online shop's cart. Before confirming the order, the User can review and modify the products, quantities, and shipping details. Payment is processed through the payment gateway integrated into the platform (Webnode) and its providers; the Owner does not store full payment card details.

The contract is considered complete at the moment the User receives order confirmation by email.

6. Shipping and delivery

Delivery times, shipping zones, and associated costs are detailed on our [Shipping Information] page. Stated timeframes are estimates and may vary for reasons beyond the Owner's control (carrier incidents, force majeure, etc.).

7. Right of withdrawal 

In accordance with Royal Legislative Decree 1/2007 (Recast Text of the General Law for the Defense of Consumers and Users), if the User has consumer status, they have 14 calendar days from receipt of the product to withdraw from the purchase without justification, by notifying oriol@sensenu.com.

Items made to the customer's specifications or clearly personalized (e.g., custom orders) are excluded from the right of withdrawal, in accordance with Article 103 of the aforementioned law.

In the case of valid withdrawal, the Owner will refund the amount paid (excluding, where applicable, shipping costs) within a maximum of 14 days from receipt of the returned product or proof of its shipment, using the same payment method used by the User, unless otherwise expressly agreed.

8. Exchanges and returns 

The specific conditions for exchanges and returns (product condition, timeframes, associated costs) are detailed on our [Exchanges and Returns] page.

9. Legal warranty 

Products carry the legal warranty of conformity provided under current consumer protection regulations (3 years from delivery, in accordance with Royal Decree-Law 7/2021). If a product is not conforming, the User may request repair, replacement, a price reduction, or termination of the contract under the legally established terms, by contacting oriol@sensenu.com.

This warranty does not cover wear from normal use, nor damage caused by improper use.

10. Third-party links 

The website may contain links to third-party sites. The Owner assumes no responsibility for the content, policies, or practices of such sites.

11. Dispute resolution 

In the event of a dispute, Users with consumer status may use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr/

12. Governing law and jurisdiction 

These terms are governed by Spanish law. For any dispute, and without prejudice to the rights granted to the User under consumer protection regulations (who may go to the courts of their own home address if they have consumer status), the parties submit to the Courts and Tribunals of El Vendrell/Tarragona.

13. Amendments

The Owner may amend these Terms and Conditions of Sale to adapt them to legislative changes or changes in how the shop operates. The terms applicable to each order will be those in force at the time it is placed.
